Direct answer
What is liability insurance in Germany?
Personal liability insurance (Privathaftpflichtversicherung or PHV) is generally voluntary in Germany. It checks whether a third-party claim against you is legally justified, pays covered justified claims up to the contractual limits, and defends against unfounded claims.
It does not cover every accident. The applicable law, the facts, insured people, private activity, exclusions, limits and complete policy wording determine the result.
Legal foundation
Liability comes before insurance coverage
Was anyone legally liable?
Section 823 BGB is one important basis: a person who intentionally or negligently and unlawfully injures another person’s life, body, health, freedom, property or another protected right must compensate the resulting loss. Other legal bases and defences may apply.
A mishap does not automatically create liability. Responsibility, fault where required, causation and the amount of loss still need to be established.
Does the contract respond?
Section 100 VVG describes the central liability-insurance function: release from qualifying third-party claims and defence against unfounded claims. Section 101 addresses necessary judicial and out-of-court defence costs within its framework.
Insurance cannot create liability where none exists, and legal liability does not guarantee cover when the event, person or activity falls outside the policy.
The insurer’s job
More than reimbursement
Investigate
The insurer examines the event, evidence, legal basis, causation and amount. A demand or invoice alone does not prove liability.
Settle covered claims
If responsibility and coverage are established, the insurer handles covered compensation up to the applicable overall limit and sublimits.
Reject unfounded demands
Passive legal protection means defending you against a claim that is legally unfounded or excessive—not funding every unrelated legal dispute.
Claim categories
What kind of third-party loss is involved?
These are policy architectures, not universal promises.
Bodily injury
Medical treatment, rehabilitation, lost earnings, care, pain-and-suffering compensation and future payments can make this the most consequential category.
Property damage
Physical damage to another person’s property. Settlement follows the legal loss, which may involve repair, current value, depreciation or residual value—not automatically a brand-new replacement.
Financial loss
Defined economic loss can be covered, but pure financial loss, contractual penalties and business opportunity losses require careful wording and may be restricted.
Voluntary cover
PHV is not mandatory for everyone
BaFin describes private liability as voluntary, unlike motor-vehicle liability. Some professions, activities, pets or state-law situations can have separate requirements, but they do not turn PHV into one universal legal obligation.
Intention
Accident is not intent
Section 103 VVG excludes the insurer’s obligation where the policyholder intentionally and unlawfully causes the third party’s loss. Do not misdescribe an intentional act as an accident.
Contract language
The full documents control
Read the application, schedule, product information, general terms and special clauses together. An English summary or comparison label is not the policy.
Household cover
Partners and adult children require exact definitions
“Family policy” is not a universal legal status. The insured-person clause may include a spouse, civil partner, named cohabiting partner and children who satisfy age, education, residence or marital-status conditions.
A shared address alone does not prove that a partner is insured. Claims between people on the same contract can also be excluded or limited.
Adult children can lose cover after education, permanent employment, marriage, a move or the end of a transition period. Separation and divorce can also create an immediate need for separate cover.
Review names and status after every major household change rather than waiting for a claim.
Children
Legal responsibility, supervision and optional settlement are three different questions
Child’s responsibility
Under section 828 BGB, children under seven are not responsible for damage. A separate rule generally applies from seven to under ten for accidents involving a motor vehicle, railway or suspension railway, subject to the statutory exception.
Supervisor’s liability
Parents are not automatically liable for everything a child does. Section 832 BGB separately addresses breach of a duty to supervise and allows exoneration where proper supervision was provided or the loss would have occurred anyway.
Optional child clause
If nobody is legally liable, standard liability cover may have no claim to pay. A clause for deliktunfähige Kinder can nevertheless settle defined damage, subject to its own people, limits and conditions.
Situations to inspect
Common expat questions are clause questions
Tenancy and rented property
Mietsachschäden may include negligent damage to rented residential rooms or fixtures. Ordinary wear, gradual deterioration, glass, heating systems or movable furnishings can be excluded or handled separately. Borrowed and rented movable items need their own wording check.
Private and work keys
A lost key can trigger replacement and locking-system demands, but legal necessity must still be established. Private keys, employer keys, access cards, security costs, sublimits and deductibles may differ.
Pets
Small household pets may fall within PHV. Dogs and horses generally require separate animal-owner liability. State-law requirements for dogs can vary, so a move within Germany can change the regulatory check.
Professional and freelance work
Private liability does not substitute for professional indemnity or business liability. Client advice, commercial operations, employer property and professional keys may be excluded or require a separate extension.
Travel and moving abroad
“Worldwide” does not automatically mean permanent worldwide residence. Compare duration, regions, foreign rented homes, defence under foreign law, document language and what happens after deregistration or relocation.
Hobbies and mobility
Cycling, e-bikes, drones, boats, construction, volunteering and powered devices can fall into different legal or policy categories. Use exact technical and activity facts rather than a marketing label.
Exclusions and limits
Do not infer cover from one headline limit
- Intentional and unlawful damage
- Own loss and certain claims between co-insured people
- Professional, freelance, trade or business activity
- Motor risks requiring separate liability insurance
- Dogs, horses and specified animals
- Fines, penalties and purely contractual liability beyond law
- Wear, gradual deterioration and known prior claims
- Borrowed/rented property without an extension
- Undeclared property, construction or hazardous activities
- Restricted drones, boats, powered cycles or foreign residence
- Sublimits, deductibles and annual aggregate limits
- Notification, cooperation and evidence obligations
An exclusion list is not complete without the chosen policy. Compare the full terms and endorsements that will form the contract.
Neutral comparison
“Best” means best contractual fit—not one universal winner
No provider ranking is presented here. A fair market table would require complete, current and comparable official terms across the selected market. Instead, use these criteria against each real offer.
| Criterion | What to record | Why it matters |
|---|---|---|
| Overall limit | Per event, annual aggregate, shared people | Severe bodily injury can exceed ordinary savings |
| People | Partner, children, adult-child transitions | “Family” labels differ |
| Rental and keys | Rooms, movable items, private/work keys, sublimits | Frequent expat-specific gaps |
| Children | Delict-incapable-person clause and amount | Can settle when nobody is legally liable |
| Bad-debt cover | Minimum loss, judgment, enforcement, territory | Protects in the reverse direction under conditions |
| Activities | Pets, cycling, drones, volunteering, property | Private scope is not unlimited |
| Abroad | Countries, duration, relocation, foreign defence | Travel and residence are different |
| Claims route | Language, evidence, channels, deadlines | Operational clarity matters during a loss |
Limits and people
Record per-event and annual limits, household members and adult-child transitions.
Rental, keys and children
Separate rented rooms, movable items, private/work keys and delict-incapable-person wording.
Bad debt and activities
Check thresholds, evidence, pets, mobility, volunteering, property and business boundaries.
Abroad and claims
Record territory, maximum duration, relocation rules, language, evidence and notification route.
Optional clauses
Useful only when the conditions work
Bad-debt cover
Forderungsausfalldeckung can cover defined loss where another person is liable to you but cannot pay. Check minimum losses, final judgment, enforcement attempts and exclusions.
Courtesy damage
A Gefälligkeitsschäden clause may address defined damage while helping friends or neighbours. It does not replace analysis of legal liability and contract conditions.
Borrowed property
Borrowed or rented movable items can be outside basic wording. Check what is included, item categories, maximum amounts and deductible.
After an incident
Eight practical claims steps
Prevent more harm
Obtain emergency help and take reasonable safety steps.
Record facts
Note time, place, sequence, witnesses and photographs.
Exchange details
Share contact information without signing an admission.
Notify promptly
Follow the policy route. Section 30 VVG also contains a statutory notice rule after knowledge of the insured event.
Forward demands
Send invoices, letters, lawyer mail and court documents immediately.
Do not settle alone
Coordinate before admitting liability or promising payment.
Cooperate accurately
Answer factually and correct mistakes; never alter evidence.
Get the outcome
Request the decision and relied-on clause in writing.
Notifying an insurer does not suspend court or authority deadlines. Seek qualified legal help for urgent deadlines, major injury or disputed rights.
Frequently asked questions
Short answers before comparing
Is personal liability insurance mandatory in Germany?
PHV is generally voluntary. Motor, profession-, activity-, pet- or state-specific requirements are separate questions.
Does it cover my own belongings?
No. PHV principally addresses covered third-party claims against you. Your possessions are generally a home-contents question.
Are my children automatically covered?
Not always. Household wording and age, education, residence or marital-status conditions matter. Damage by a child who lacks legal responsibility may need a separate clause.
Does it cover a lost apartment key?
It can if private third-party key loss is included and you are legally liable. Wider locking-system replacement must still be necessary; work keys can have separate rules.
Does it cover accidental damage at work?
Do not assume so. Professional and commercial activity is a core boundary; separate business or professional cover may be needed.
What if an uninsured person injures me?
Ordinary PHV protects against claims made against you. Optional bad-debt cover can address defined reverse-direction cases only after its contractual proof, thresholds and enforcement conditions are met.
