Legal expenses insurance in Germany
The legal area, insured event and policy terms need to fit the dispute. A coverage decision is a separate question from winning a case.

Start with these three questions.
Covered area
Check the module, insured people and type of dispute.
Timing and terms
Read the event definition, waiting period, limits and exclusions.
Coverage decision
Ask about the specific matter and procedural stage.
Modular cover
Private, employment, traffic, housing, landlord and business risks are different
Private matters
Can cover selected disputes from everyday private life. Employment, traffic, property and business risks may require separate modules.
Employment
Designed for disputes arising from employed work, such as dismissal, warnings, references or pay where included. It is not business cover.
Traffic
May protect different road-user roles, but insured vehicles, licence conditions, legal services and waiting-period rules must be checked.
Housing and tenancy
Normally linked to the insured property and stated role, such as tenant or owner-occupier. Construction and financing disputes can be excluded.
Landlord
Do not assume ordinary housing cover includes rented property. The landlord role and relevant property generally need to be insured.
Business or self-employed work
The policy must match the stated commercial or professional activity. Private or employee cover does not automatically insure company disputes.
Timing
The insured event is not simply the date you contact a lawyer
Policy definitions control
Depending on the legal service, terms may use a loss event, an alleged breach of duty or law, or a change in legal circumstances. For breach-based cover, the objective facts used to allege the other party’s violation are central.
A lawsuit or legal consultation starting after inception does not by itself place the dispute inside the insured period.
Existing and foreseeable disputes
A new policy generally does not cover a dispute whose relevant cause arose before cover began. Some terms contain narrow continuity or prior-insurer rules, but only the wording can establish them.
Do not buy cover after a conflict starts and assume it works retroactively.
Waiting periods
Common, but not uniform
BaFin and Verbraucherzentrale describe three months as common, while shorter, longer or no waiting period can apply depending on the module and event. A traffic accident or offence-related service can be treated differently from vehicle-contract or administrative disputes.
Never rely on the product label
Record the policy start, exact waiting period, any previous uninterrupted cover and the date of every fact said to trigger the conflict. “Traffic cover has no waiting period” is too broad.
Limits
Costs, exclusions and procedural stages must all match
Covered costs
Depending on the contract, statutory lawyer fees, court costs, witnesses, experts and certain opposing-party costs may be included.
Deductible
Check the amount and how it applies to each insured event. Do not assume it is charged per year, lawyer, court level or dispute without reading the rule.
Policy limit
Read the overall limit, geographic sublimits, bail-loan provisions, translation costs and any cap for advice or mediation.
Procedural stage
Advice, out-of-court work, mediation, objection proceedings and litigation may be treated separately. Obtain cover for the intended stage.
Typical exclusions
Family and inheritance disputes, construction, investments, gambling, intentional offences, company law or non-contractual defence can be excluded or limited. Examples are not universal.
Intentional conduct
Section 81 VVG addresses intentional and grossly negligent causation, while criminal legal protection also depends on its own definitions. An allegation and a final conviction are not the same.
Coverage request
Ask for a written decision for the specific matter and stage
Identify the insured person and role
Private individual, employee, driver, tenant, landlord, owner-occupier, self-employed person or company.
Describe the facts and dates
Provide a neutral chronology, the alleged legal violation, documents received and every deadline.
Name the module and legal service
State whether the request concerns advice, representation, mediation, an objection or court proceedings.
Request the reason and clause
If cover is denied, ask which policy clause, exclusion, timing rule or cost limit supports the decision.
Protect legal deadlines
A coverage request does not stop court, authority, employment or limitation deadlines. Obtain qualified legal help where a deadline may run.
Denial and lawyer choice
Cost-cover review is separate from the underlying dispute
Prospects of success or frivolous action
If an insurer denies cover because the proposed action lacks sufficient prospects of success or is considered frivolous, section 128 VVG requires an impartial review procedure in the contract and information about that procedure.
This rule does not automatically decide denials based on timing, waiting periods or exclusions.
Choice of lawyer
Section 127 VVG provides a choice among lawyers whose remuneration the insurer bears under the contract. It does not promise reimbursement of any lawyer at any privately agreed fee.
A positive coverage decision confirms contractual cost protection for the stated matter; it is not a court ruling and cannot guarantee success.
Mediation and cross-border cases
Territory, procedure and language are separate checks
Mediation
Some policies include mediation, but scope, cost limits and mediator or lawyer choice depend on the contract and applicable legal framework. Do not assume every informal settlement process is insured.
Territory
Check where the insured event occurred, which court or authority has jurisdiction, the applicable law and any reduced worldwide limit or time restriction.
Language
Territorial cover does not guarantee English advice, English proceedings or reimbursement of every translation. Check the actual service and necessary-document rules.
Cross-border enforcement
A favourable judgment and the cost of enforcing it abroad are different questions. Confirm whether enforcement, local counsel and translations are included.
Without cover
Legal costs do not disappear when insurance declines
General civil litigation
Under section 91 ZPO, the unsuccessful party generally bears court costs and reimburses necessary opposing-party costs. Your own fee agreement and recoverable statutory fees can differ.
Employment disputes
In first-instance German labour-court proceedings, each side generally bears its own lawyer’s fees regardless of who wins.
Public assistance
Beratungshilfe and Prozesskostenhilfe have financial and merits conditions and do not simply replace an insurance policy. Court-cost assistance can leave some opposing-party costs payable.
Trade unions, tenant associations, professional bodies or liability insurers may help only within their own membership or contractual scope.
Official sources
Law, courts, supervision, justice services and consumer guidance
Policy-specific details still require the current schedule and full terms.
