Not to your gross salary.
Membership, allowances and special cases still matter.
Start with these three checks.
Establish membership
Check whether you belong to a religious community that levies the tax.
Use the correct base
The usual 8% or 9% is a percentage of relevant income tax, not salary.
Check the record and period
Payroll data, a formal exit and the annual assessment have distinct roles.
What is church tax in Germany?
Kirchensteuer is a tax levied by religious communities entitled to do so under the applicable law. For the usual wage- and income-tax surcharge, the starting questions are membership and residence. German citizenship is not the test, and living in Germany does not mean that everyone pays it. [1]
For someone arriving from abroad, a useful first step is to establish the actual membership position. If a past baptism, church registration or formal exit creates uncertainty, ask the relevant church-tax office which evidence it needs. Do not treat attendance or personal belief as a substitute for checking the legal record.
How much is church tax?
The standard rate is 8% in Bavaria and Baden-Württemberg and 9% in the other federal states, applied to the relevant income-, wage- or capital-income-tax base. [2]
| Location | Standard rate | If the relevant tax base is €1,000 |
|---|---|---|
| Bavaria or Baden-Württemberg | 8% | €80 church tax |
| Other federal states | 9% | €90 church tax |
This example only shows multiplication. The €1,000 is an assumed tax amount, not gross pay or taxable income. It is not a calculation of an individual payslip, annual assessment or saving from leaving a church.
Child allowances and other statutory adjustments can change the surcharge base. Section 51a EStG sets out the relevant adjustments. That is why multiplying an arbitrary figure from a payslip can produce the wrong result. [3]
Where does church tax appear on a payslip?
An employer uses the electronic wage-tax characteristics, ELStAM, for payroll. The stored characteristics include the church-tax marker as well as the tax class, child-allowance information and other relevant entries. [4]
- Find the church-tax deduction, often labelled Kirchensteuer, KiSt or KiSt Lohn.
- Ask payroll which church-tax marker and period it used.
- Compare that with your registration and any membership or exit documents.
- Ask the responsible tax or church-tax office how to correct a discrepancy.
Keep copies of the payslip and the evidence with your enquiry. Our tax-class guide explains another part of the same payroll record; the salary calculator can illustrate only the cases stated in its assumptions.
What if the church-tax entry is wrong?
Correcting an inaccurate record and leaving a religious community are different processes. Berlin’s official guidance directs employees with an incorrect deduction or missing deduction to the church-tax office at the relevant Finanzamt. Updates transmitted through registration records can take time. [1]
Make the enquiry specific. Include the relevant payroll month, the marker used, the reason you believe it is wrong and the documents supporting that reason. Ask both when the corrected data will apply and how earlier withholding should be dealt with.
Do not assume that telling payroll to stop the deduction establishes that no tax is due. Equally, the presence of a deduction is not a final decision on a disputed membership record.
Does church tax also apply to investment income?
It can. Where the statutory withholding procedure applies, the institution obtains the church-tax characteristic through the Bundeszentralamt für Steuern and withholds the relevant surcharge. This is separate from your employer’s payroll process. [3]
For the special capital-income tax calculation, church tax also affects the underlying tax formula. Do not add 8 or 9 percentage points directly to the usual 25% capital-income rate. Section 32d provides the calculation framework; ING’s official explanation describes its application to bank withholding. [5]
An eligible Freistellungsauftrag can affect whether capital-income tax, and consequently its church-tax surcharge, is withheld. Read the capital gains tax guide before using the illustrative calculator.
A Sperrvermerk blocks the automated disclosure of religious affiliation; it is not an exemption from church tax. Section 51a links it to a tax-return obligation for the relevant years in which capital-income tax was withheld. [3]
Can you deduct church tax in a tax return?
Paid church tax can generally qualify as a special expense, Sonderausgabe, under section 10(1) no. 4 EStG. The provision excludes church tax paid as a surcharge to capital-income tax or income tax calculated under the special section 32d(1) rate. [6]
A deduction reduces the relevant tax calculation; it is not a promise to refund the whole payment. Retain records of payments and refunds and use the appropriate fields in your tax return. For a disputed assessment or a mixed-faith household, obtain an assessment of the actual facts rather than relying on this simplified overview.
How does a formal church exit work?
A Kirchenaustritt is a formal declaration. The responsible authority, procedure and fee depend on the location. Use the official state or municipal service for your residence, and keep the issued certificate.
Berlin example: the declaration is made at the competent Amtsgericht, either personally or in writing with a notarised signature. An ordinary online declaration does not complete the exit. Berlin states that church-tax liability ends at the end of the month in which the declaration reaches the court. This local example should not be treated as instructions for every federal state. [7]
- Find your official local procedure and required documents.
- Complete the declaration in the prescribed form.
- Keep the certificate and effective date permanently with your records.
- Check later payslips and ask about any delay or discrepancy.
- Keep the exit documentation for the annual assessment.
A change during the year can involve an annual calculation and a time allocation. Do not assume that multiplying one monthly deduction by the months remaining gives the final annual effect. Membership and religious consequences are separate from the payroll amount.
Common questions
Is church tax 9% of my salary?
No. The standard 8% or 9% surcharge applies to the relevant tax base. The example above deliberately starts with a tax amount, not gross salary.
Do expats have to pay church tax?
Foreign nationals can be liable when the membership, residence and other legal conditions are met. Nationality alone neither creates nor removes liability.
Can I stop it by changing a payroll form?
A payroll request does not replace a required record correction or formal church exit. Establish the actual status and follow the official procedure.
Does a data-disclosure block remove the tax?
No. A Sperrvermerk concerns automated information retrieval for investment withholding. It can create a reporting obligation instead of removing the underlying tax.
Does this guide cover every church charge?
No. It focuses on the common income-tax surcharge. Special church contributions, mixed-faith cases, caps, refunds and cross-border situations may require a separate assessment.
